These Terms of Service ("Terms") govern your use of the FREEROAM mobile application ("FREEROAM," the "App"), which is operated by Kaizen Works LLC, a Colorado limited liability company ("Kaizen Works," "we," "us"). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
FREEROAM is offered in the United States and Japan and is not directed to users in the European Union or the United Kingdom.
You must be at least 16 years old to create an account. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. You may only use driving features (drive recording, navigation, cruises) as a licensed driver operating a vehicle legally, or as a passenger.
Never interact with the App while driving. Set up navigation, recording, or a cruise before you start moving, and let passengers handle the App while the vehicle is in motion.
Assumption of risk. You acknowledge that driving, attending automotive events, and participating in group drives ("cruises") involve inherent risks, including serious injury or death, and you voluntarily assume all such risks. Other users are not vetted, screened, or endorsed by us, and you are solely responsible for your interactions with them.
Not an emergency service. The App is not a safety, roadside-assistance, or emergency service. Its voice, live-location, and navigation features depend on network and device conditions and may fail or be delayed without warning. Never rely on the App to summon help or as your only means of communication.
To the maximum extent permitted by law, FREEROAM is not responsible for accidents, citations, injuries, or damages arising from your driving or your use of the App while driving.
Keep your credentials secure; you are responsible for activity on your account. Provide accurate information and do not impersonate others. You can delete your account at any time in the App.
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You agree not to:
FREEROAM has a zero-tolerance policy for objectionable content and abusive behavior. You must not post, share, transmit (including via voice chat), or organize:
This applies to everything you contribute: usernames, avatars, events, event images, shared roads, and cruise voice communications.
We may remove any content and suspend or terminate any account at any time, without notice, for conduct that violates these Terms or that we reasonably consider objectionable or harmful. We review reports of objectionable content and act on them within 24 hours by removing the content and/or ejecting the user who provided it.
You can report objectionable content and block abusive users directly in the App. Blocking a user hides their content from you. If you'd rather reach us directly, use the contact address below.
You own the content you create. By posting content to shared surfaces (events, marketplace roads, avatars, voice messages), you grant FREEROAM a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute that content solely to operate and provide the App. This license ends when your content or account is deleted, except where content has been shared with others or as required for legal compliance.
We respect intellectual-property rights and expect our users to do the same. If you believe content in the App infringes your copyright, send a notice that complies with 17 U.S.C. § 512(c)(3) to our designated agent at support@freeroamdrive.com. Your notice should identify the copyrighted work, identify the infringing material and where it appears in the App, provide your contact information, and include the good-faith-belief and accuracy statements required by law. We will remove infringing content and terminate the accounts of repeat infringers.
The App relies on third-party services (including Supabase, Mapbox, Agora, Open-Meteo, Expo, and OpenStreetMap data). Their availability is outside our control, and map data is provided under their respective terms. Map data © OpenStreetMap contributors.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ROUTE, MAP, SPEED LIMIT, WEATHER, OR TIMING INFORMATION WILL BE ACCURATE OR CURRENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAIZEN WORKS LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE APP — INCLUDING DAMAGES ARISING FROM DRIVING, NAVIGATION, ROUTE INFORMATION, EVENTS OR MEETUPS ORGANIZED THROUGH THE APP, OR THE CONDUCT OF OTHER USERS. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS OR US $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
You agree to indemnify and hold harmless Kaizen Works LLC and its officers, members, employees, and agents from claims arising out of your content, your driving, your violation of these Terms, or your violation of any law or third-party right, including reasonable attorneys' fees and costs.
You may stop using the App or delete your account at any time. We may suspend or terminate your access at any time for violation of these Terms (including the zero-tolerance policy above) or to protect the service and its users. Sections that by their nature should survive (content licenses for already-shared content, disclaimers, limitations of liability, indemnification, dispute resolution, and governing law) survive termination.
We may update these Terms from time to time. We'll revise the "Last updated" date and, for material changes, notify you in the App. Continued use after changes take effect constitutes acceptance.

Before filing any claim, you agree to first contact us at support@freeroamdrive.com and try to resolve the dispute informally for 30 days.
Any dispute arising out of or relating to these Terms or the App that is not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court — except that either party may bring an individual claim in small-claims court. The arbitration will be held in Colorado or, at your election, by videoconference or in your home county.
You and Kaizen Works each waive the right to a jury trial and the right to participate in a class action, class arbitration, or any representative proceeding. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court.
Opt-out. You may opt out of this arbitration agreement by emailing support@freeroamdrive.com within 30 days of first accepting these Terms; opting out will not affect any other part of these Terms.
Governing law and venue. These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Any claims not subject to arbitration will be brought exclusively in the state or federal courts located in Denver, Colorado, and you consent to their jurisdiction.
These Terms are between you and Kaizen Works LLC, not Apple Inc. ("Apple"). Apple is not responsible for the App or its content and has no obligation to furnish any maintenance or support for it. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund any purchase price you paid for the App (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims relating to the App, including product-liability, consumer-protection, or intellectual-property claims. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist-supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain in full effect. These Terms are the entire agreement between you and us regarding the App and supersede any prior agreements on the subject. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets; you may not assign them. Our failure to enforce any provision is not a waiver of it. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
